  • Project Information: Names of gift recipients, relationship descriptions, personal stories, memories, inside jokes, significant dates, and relevant geographic locations.
  • Visual Materials: Photographs, video clips, and scanned documents. Spatial Data (Experimental): Multi-angle imagery used for 3D environment reconstruction (Gaussian Splatting) is collected only if you opt-in to our experimental beta features.
  • Creative Preferences: Musical genre preferences, visual aesthetic requests, and color palettes.
  • Payment Information: Billing name/address and payment card data (processed securely by Stripe; we do not store full card numbers).

1.2 Information Collected Automatically

  • Technical Information: IP address, browser type/version, device type, and referring URLs.
  • Analytics Data: Session duration, general geographic location, and navigation paths.

2. How We Use Your Information

  • Service Delivery: To create custom songs based on your stories, produce cinematic videos, distribute your track to streaming platforms, and deliver final files.
  • Communication: To send project updates, request approvals, and provide support.
  • Business Operations: To process payments, manage internal records, and train our team on quality standards.
  • Marketing & Portfolio Use: We only feature testimonials or identifiable reaction videos with your explicit written consent. We may use completed works in our portfolio in accordance with your specific service agreement.

3. How We Share Your Information

We do not sell your personal information. We share information only with:

  • Service Providers: Partners who assist in delivery, including payment processors (Stripe), cloud storage (Microsoft 365), music distributors (DistroKid), and AI processing tools (text prompts only).
  • Streaming Platforms: When your song is distributed, the song audio, title, artist credit (Tenderframe), approved lyrics, and album art become publicly available on platforms like Spotify and Apple Music.
  • Legal Requirements: If required by law, subpoena, or to protect our legal rights.

4. AI-Generated Content and Data Processing

We utilize commercial-tier artificial intelligence tools to create music and visual content. We protect your privacy in these systems through the following measures:

  • Abstraction: We convert your personal stories into creative prompts that describe emotions, scenes, and styles—not identifying personal information.
  • Generative Image & Media Processing: To deliver our signature cinematic quality, we utilize generative AI platforms (such as Midjourney) as needed. Your uploaded images and media may be processed through these tools to enhance, stylize, or reconstruct scenes. If you require tighter control over how your personal media is handled, you may explicitly request restrictions during the project intake process.
  • Ethical Boundaries: Governed by our "Do No Harm" policy, we never create deceptive deepfakes, animate deceased persons to speak, or generate AI imagery of minors.

5. Music Distribution and Public Availability

When you commission a song from Tenderframe, it is distributed to public streaming platforms so you can activate it via voice commands (e.g., "Alexa, play my song").

  • What Becomes Public: The song audio, title, Tenderframe artist credit, album artwork, and approved lyrics.
  • What Remains Private: Your contact info, intake form responses, personal photographs, and payment details.
  • Removal Requests: You may request to have your song removed from streaming platforms at any time by contacting us, though third-party caching may delay full removal.

6. Data Storage, Security, and Retention

We use enterprise-grade encryption (Microsoft Azure/SharePoint) to store your project files and client records. We limit data access strictly to authorized personnel.

Retention Schedule:
  • Intake Data & Communications: Deleted 90 days after delivery to protect client intimacy.
  • Project Deliverables (Finals): Retained for 3 years to support re-orders and QA.
  • Client & Payment Records: Retained for 7 years for tax and legal compliance.
  • Distributed Songs: Indefinite (unless removal is requested).

7. Multi-Contributor Projects

For group projects (e.g., The Love Story/Tier 2), the primary client ("Coordinator") may share an upload link with friends/family. By uploading content, contributors consent to Tenderframe's use of their materials for the project. The Coordinator is solely responsible for informing contributors how their materials will be used publicly.

8. Children's Privacy

Our services are not directed to individuals under 18. By uploading family photos containing minors, you represent that you are the legal guardian or have obtained necessary consent. We absolutely do not generate AI imagery of minors.

9. Your Rights and Choices

Depending on your location (including the CCPA for California residents), you may have the right to:

  • Access, correct, or request deletion of your personal information.
  • Opt-out of marketing communications.
  • Restrict or object to our processing of your data.
